The Bombay High Court on Monday directed the monitoring committee of Sanjay Gandhi National Park (SGNP) to determine whether a single artificial pond in Aarey Colony would suffice for the immersion of Ganpati idols, with the intention of respecting religious sentiments.
A division bench comprising Chief Justice D K Upadhyaya and Justice Arif Doctor stated that if the committee deems it necessary to have more artificial ponds, the requisite arrangements should be made.
The court noted, “These are all matters for experts to consider. Whether one artificial pond is sufficient or if six, a truck-mounted tank, or ten are required, is at the discretion of the monitoring committee.”
“Our aim is not to offend anyone’s religious feelings… We will request the committee to contemplate and make an appropriate decision. If one pond is adequate, that’s great, but if not, we are only suggesting that arrangements can be made,” Chief Justice added.
The bench was hearing an application submitted by a Vishwa Hindu Parishad (VHP) leader seeking permission for idol immersion in Aarey Colony lakes. This year, the CEO of Aarey Colony denied permission for lake immersions.
During the hearing, the petitioner’s counsel, Anil Singh, informed the court that the monitoring committee had convened a meeting and decided to establish an artificial pond inside Aarey, where immersions have been taking place since last Wednesday. Senior counsel Milind Sathe, representing the BMC, informed the court that six truck-mounted tanks had been provided for immersion.
Singh argued, “However, one pond is insufficient given the number of idols brought for immersion. Last year, in addition to lake immersions, seven artificial ponds were created. We are not seeking permission to immerse in lakes this time, but we are merely requesting additional artificial ponds.”
