CG HC Allows Husband’s Divorce Petition as Wife Used to Consume Alcohol and Tobacco

The Chhattisgarh High Court has said in one of its judgments, “If the wife harasses the husband by consuming meat with gutkha and alcohol, it amounts to cruelty. The double bench of Bilaspur High Court Justice Gautam Bhaduri and Justice Radhakishan Aggarwal said that such cruelty is the basis of divorce. This whole matter is related to Korba district. A young man from Bankimongra of Korba was married to a girl from Katghora. Just seven days after the marriage, on the morning of 26 May 2015, his wife was lying unconscious in bed.

When the husband took her to the doctor, it was found that she was addicted to non-veg and gutkha along with drinking alcohol. Even after this, he did not agree and it is alleged that the wife started misbehaving with the in-laws. The wife used to eat gutkha and spit here and there in the bedroom and started quarreling on refusal.

The in-laws saved his life by extinguishing the fire. After this, while trying to commit suicide twice by jumping from the roof and twice by drinking insecticide, he accused the in-laws only. But the family court of Korba rejected the petition filed by the husband for divorce. After which the husband filed an application in the High Court. The High Court, while accepting the writ appeal of the husband, ordered that the Family Court should have taken into account the facts in the hearing.
