Jammu’s Prakash Come out of Jail, Sudama of Banaras Furnished Surety

Justice has begun and justice is visible not only in the plains but also in the valleys and mountains.

The Jammu & Kashmir court released a man, who was sent to judicial lockup in default of furnishing bail bonds in 2001.

Jai Parkash was booked by Jammu & Kashmir Police in 2000 for allegedly committing offenses that are punishable under the provisions of the Arms Act. The said offences are bailable in nature.

Parkash has now also filed a plea in the High Court of Jammu & Kashmir and Ladakh through advocate Irfan Khan seeking compensation and action against those who are involved in making his 22 years hell.

On his plea, the High Court issued notices to the Counsel for the Union Territory and called for the records of the case from the City Judge’s Court. The matter is scheduled be heard on January 31, 2023.

After investigation, the charge-sheet was laid before the City Judge and it was clearly indicated in the charge-sheet that the person booked for the offence appears to be a “lunatic”.

Subsequently, in January 2002, the judge sent Parkash to judicial Lockup in default of furnishing the bail bonds.

Another order was also passed by the judge in May 2002 in which it was noted that Head of the Psychiatry Department of the Government Medical College, Jammu, had reported that the accused was suffering from chronic mental illness.

Thereafter, the judge had directed that the accused be admitted for his treatment to Psychiatric Hospital and Superintendent, District Jail was asked to do the needful. Since then Parkash was in judicial custody.

A day before, Parkash was released by the Civil Judge since once Sudama Parshad, a resident of Banaras Uttar Pradesh, furnished surety bond to the tune of ₹30,000/-.

The Judge ordered that Parkash be given adequate treatment and be assessed for his capability to stand trial.

“The accused shall get the medical treatment as well as obtain the medical condition certificate of the accused from the concerned Psychiatric Hospital and produce the same to the concerned Police Station of the area and SHO GRP Jammu after 03 months for appraisal of this court, the court said. The accused shall be produced before the court as and when the accused shall be capable to stand the trial”, the order stated.
