J&K HC Halts Deportation Of 4 Alleged Pakistani Nationals Amid Pahalgam Attack Investigation

The Jammu and Kashmir High Court has issued a stay on the deportation of four individuals accused of being Pakistani citizens, following their detention in connection with the April 22, 2025, Pahalgam terror attack that resulted in the deaths of 26 tourists in Baisaran Valley.

Court Observation

The court’s decision came after the detainees challenged their identification as Pakistani nationals and the legality of their impending deportation. They argued that they are Indian citizens and that the deportation orders were issued without proper verification of their nationality.

The High Court has directed the Union Territory administration and the Ministry of Home Affairs to respond to the detainees’ claims and provide evidence supporting their classification as foreign nationals. The court emphasized the importance of due process and the need for a thorough investigation into the individuals’ citizenship status before any deportation action is taken.

This legal development occurs amid heightened tensions following the Pahalgam attack, which has been attributed to Pakistan-based militant groups. The Indian government has accused Pakistan of supporting cross-border terrorism, leading to a diplomatic standoff between the two countries. The situation remains volatile, with increased security measures and ongoing investigations into the attack and its perpetrators.

Court’s intervention underscores the complexities involved in addressing security concerns while upholding legal and constitutional protections for individuals accused of involvement in terrorist activities.
