The Karnataka High Court recently declined to grant bail to a woman who stands accused of fatally stabbing her husband.
In its ruling, the Court emphasized that the petitioner’s gender alone is not a sufficient ground for her release.
The bail plea was filed by the woman, who is facing charges of murder, criminal conspiracy, and other offenses under the Indian Penal Code.
Justice Mohammad Nawaz, considering the seriousness of the alleged crime, dismissed the bail application. The Court stated that there is a prima facie case against the petitioner and highlighted the grave nature of the offense. It firmly stated that gender cannot be a basis for granting bail.
Furthermore, the Court noted that even if bail were granted to a co-accused involved in the murder conspiracy, it would not benefit the petitioner’s case. Consequently, the bail plea was rejected.
According to the prosecution, the woman and her lover conspired to murder her husband with the intention of continuing their illicit relationship. It is alleged that she stabbed her husband while he was sleeping and inflicted injuries on herself with the same knife to stage a robbery.
Initially, a complaint was filed against unknown individuals by the landowners. However, after a thorough investigation, the woman and her lover were apprehended by the authorities.
In rejecting the bail plea, the Court also took into account the statement provided by the accused woman’s son, who claimed that there was a quarrel between his parents the night before his father’s demise. The following morning, the son discovered his father deceased with stab wounds.
