The Allahabad High Court ruled on Thursday that the trial in 18 cases related to the Krishna Janmabhoomi-Shahi Idgah dispute in Mathura can proceed. This decision came as the court dismissed a petition from the mosque committee challenging the maintainability of these suits.
On June 6, a single bench of Justice Mayank Kumar Jain had reserved judgment on the petition from the Muslim side concerning the maintainability of the suits.
The court has now scheduled August 12 for the framing of issues.
The suits, filed by Hindu litigants, seek the “removal” of the Shahi Idgah mosque situated next to the Krishna Janmabhoomi temple. The petitions argue that the Aurangzeb-era mosque was constructed following the demolition of the temple. However, the mosque management committee and the UP Sunni Central Waqf Board contended that the suits are barred under the Places of Worship (Special Provisions) Act, 1991, which prohibits altering the status of any place of worship from what it was on the day of the country’s Independence.
