A Gujarat High Court judge Justice Samir Dave has recently recused himself from hearing the bail application of Dineshkumar Dave, a manager from the Oreva Group. This application is related to the Morbi bridge collapse case, which resulted in the tragic deaths of 135 individuals in 2022.
Previously, in May, Justice Dave had granted bail to three security guards who were accused in the same case. Additionally, in the first week of June, he had also granted bail to two booking clerks implicated in the incident.
During the court proceedings, when Dineshkumar Dave’s bail application was mentioned, Justice Dave recused himself, stating, “Is this the Morbi one? Not before me.”
More recently, Jaysukh Patel, the managing director of Oreva, filed a bail application with the high court. This came after a similar plea was denied by a sessions court on April 1.
A total of ten individuals have been accused in connection with the collapse of a suspension bridge in Morbi, Gujarat, which occurred on October 30, 2022, claiming the lives of 135 people. The charges against the accused include various sections of the Indian Penal Code (IPC), such as culpable homicide not amounting to murder (Section 304), attempt to commit culpable homicide (Section 308), acts endangering human life (Section 336), causing hurt by rash or negligent acts (Section 337), and causing grievous hurt by rash or negligent acts (Section 338).
