The Punjab & Haryana High Court has expressed strong disapproval of the Bar Association’s decision to observe a “no work day” in response to escalating tensions between India and Pakistan.
Court Observation
The court questioned the rationale behind the lawyers’ strike, emphasizing the importance of maintaining judicial proceedings during critical times.
“Soldiers are at war, and you want to rest?” the bench remarked, highlighting the contrast between the armed forces’ commitment and the legal fraternity’s decision to halt work. The court underscored the judiciary’s role in upholding the rule of law, especially during periods of national crisis.
The Bar Association had called for the “no work day” as a form of protest, citing concerns over national security and solidarity with the armed forces. However, the High Court maintained that such actions disrupt the legal process and impede access to justice for citizens.
This incident has sparked a broader discussion on the responsibilities of legal professionals during times of national unrest. While the intent to show solidarity with the armed forces is acknowledged, the court emphasized that ensuring the continuous functioning of the judiciary is paramount.
