Rajasthan HC Dismisses PIL Challenging Swearing-in of Diya Kumari & Prem Chand Bairwa as Deputy CMs

The Rajasthan High Court has dismisses a Public Interest Litigation (PIL) challenging the “swearing-in” of Diya Kumari and Prem Chand Bairwa as deputy chief ministers, contending that the Constitution does not recognize this position.

The petitioner, Om Prakash Solanki, a lawyer, has also sought the annulment of these appointments.

A bench, led by Acting (designated) Chief Justice MM Srivastava, ruled that the PIL lacked substantial material and deemed it to be a mere publicity stunt by the advocate. The court not only dismissed the PIL but also imposed a penalty of Rs 25,000 to be paid by the petitioner to the state government.

The PIL was filed on December 16, a day after Kumari and Bairwa took the oath alongside Chief Minister Bhajanlal Sharma.
