Sexual Harassment Case: Kerala High Court Allows Bail Plea Of Boby Chemmanur

The Kerala High Court on Tuesday granted bail to prominent businessman Boby Chemmanur, who was taken into judicial custody following allegations of sexual harassment leveled against him by a noted Malayalam film actor. The court’s website confirmed the bail status with the succinct entry, “Allowed.”

While deliberating on the bail application, Justice P.V. Kunhikrishnan noted that Chemmanur had surrendered his passport and assured continued cooperation with the investigative process. In a brief statement during the hearing, the judge indicated, “Will pass a detailed order by 3.30 pm.”

The court observed that Chemmanur’s remarks concerning the complainant could be construed as carrying “double meanings.”

Acknowledging the problematic nature of these statements, it asserted, “We cannot say there is no double meaning,” and further criticized portions of the bail application for including language that appeared to undermine the professional credibility of the complainant, deeming such statements “insulting.”

The prosecution mounted a vigorous opposition to the bail plea, highlighting Chemmanur’s social media content, which it characterized as sexually suggestive, and warning of the potential adverse societal implications of granting bail.

Despite these concerns, the court reasoned that his detention since January 9 had already served as an adequate societal signal.

Chemmanur’s arrest took place in Wayanad on January 8. After being denied bail by the Ernakulam Judicial First Class Magistrate Court-II on January 9, he sought redress from the High Court.

In his petition, Chemmanur underscored his previously amicable association with the complainant, noting her participation in inaugurations of his jewellery outlets at Perambra in April 2019, Attingal in December 2022, and Kannur in August 2024.

The allegations against Chemmanur stem from an incident that purportedly occurred during the inauguration of a showroom in Alakode, Kannur, on August 7, 2024, wherein he allegedly made unwelcome advances toward the complainant while placing a necklace on her.

Throughout the proceedings, Chemmanur has steadfastly maintained his innocence. He currently faces charges under Section 75(4) of the Bharatiya Nyaya Sanhita, pertaining to sexual harassment, and Section 67 of the Information Technology Act, which addresses the electronic transmission of obscene material.
