Uttarakhand High Court Allows Abortion of 13 Year Old Rape Victim at 25 Weeks

The Uttarakhand High Court has permitted the Chief Medical Officer, Dehradun, to make a medical board for the abortion of a 13-year-old pregnant minor girl immediately.

The single bench of High Court’s senior judge Sanjay Kumar Mishra has given conditional permission for the abortion of a 13-year-old pregnant girl from Dehradun in an order passed on Wednesday, December 6.

The court has directed to present the information in this matter on 9th December. The victim girl is 25 weeks and 4 days pregnant. As a rule, abortion is not allowed after 24 weeks.But in special circumstances, following the orders passed by the Supreme Court and other High Courts, the Uttarakhand High Court has given this order keeping in mind the health of the 13-year-old girl.

The girl’s father and others had filed a petition seeking permission to abort the girl who became pregnant due to sexual harassment by a close relative.

At the time of hearing, the father and the victim’s daughter appeared before the court virtually. The single bench allowed this petition also after the Delhi High Court and the Supreme Court had allowed it in a few such cases.
