In today’s digital age, social media has transformed communication, including how personal matters are addressed. A notable example is the case of Shaikha Mahra Mohammed Rashid Al Maktoum, the daughter of Dubai’s ruler, who publicly announced her divorce from her husband via an Instagram post. This event raises critical questions about the intersection of social media and legal frameworks surrounding divorce.

The Unique Case of Social Media Divorce

Shaikha Mahra Bint Mohammed Bin Rashid Al Maktoum, daughter of Dubai’s ruler, has publicly declared her divorce from Sheikh Mana Bin Mohammed Bin Rashid bin Mana Al Maktoum on Instagram. This declaration comes just two months after the couple welcomed their first child.

She announced this by posting an instagram post wherein she wrote that, “Dear Husband,As you are occupied with other companions, I hereby declare our divorce. I divorce you, I divorce you, and I divorce you. Take care. Your ex-wife.”

While some followers expressed sympathy and support, others questioned the legality and validity of a woman initiating a divorce in this manner. Traditionally, Islamic law permits men to initiate divorce, while women must seek “khula,” requesting a divorce through their husbands or the court.

Legal Framework in India

In India, the legal framework surrounding “triple talaq” is particularly strict. The Muslim Women (Protection of Rights on Marriage) Act, 2019, specifically addresses this issue and consists of eight sections that criminalize the practice. Section 3 states that any pronouncement of talaq by a Muslim husband—whether spoken, written, electronic, or in any other form—shall be considered void and illegal. Furthermore, anyone found to be pronouncing talaq in violation of this section may face a prison sentence of up to three years and could also be subject to fines.
