Swati Maliwal

Delhi’s Rouse Avenue Court will hear the case against Aam Aadmi Party (AAP) Rajya Sabha MP and former Delhi Commission for Women Chairperson Swati Maliwal on February 24.

The case related to alleged irregularities in appointments at the DCW.

On Saturday, the court recorded the statement of retired Sub-Inspector Omveer, who had filed the First Information Report (FIR) in this case.

Earlier, the Delhi court had ordered to frame charges against Maliwal and others including commission members Promila Gupta, Sarika Chaudhary and Farheen Malik.

The court had ordered framing of charges against the four alleged accused under Section 120B of the Indian Penal Code and Section 13(2), 13(1)(D) of the Anti-Corruption Act.

What is the Case?

Former MLA Barkha Shukla Singh in August 2016 had complained to the Anti Corruption Bureau alleging that AAP has made appointments in the Delhi Women Commission bypassing the rules.

Barkha Singh Shukla had also given the names of the three appointed people.

Apart from this, she also attached a list of some 85 people who were related to AAP. All of them were allegedly appointed to the Women’s Commission.

According to the charge sheet filed in this case, DCW did not provide relevant information to the Ministry of Women and Child Development despite written requests by the ministry employees.

The chargesheet also states that although during the investigation the DCW claimed that interviews were conducted for recruitment.
Still, no record of the candidates or information about the date, place and time of the examination was provided by the institute.

It has also been said in the charge sheet that except for the post of Legal Counsel, no advertisement was published for other posts.

Advertisement for the post of Legal Counsel was published on the DCW website on 26 April 2016. But an appointment to this post was also made before the date.
