Delhi HC Grants Anticipatory Bail To Lawyer In Brother’s Criminal Case

The Delhi High Court has granted transit anticipatory bail to a lawyer whose brother is facing serious charges under the Uttar Pradesh Prohibition of Unlawful Conversion of Religious Act, Dowry among others.

The lawyer sought protection from arrest in this matter from Delhi HC.

The HC bench of Justice Vikas Mahajan granted transit anticipatory bail to the lawyer until the next date of hearing, considering the circumstances and the petitioner’s residence in Delhi.

What is the Case?

The allegations were made by the father of a woman, whom the lawyer’s brother was set to marry, accusing him of abetting her suicide.

The case is being handled in Uttar Pradesh. Advocates Sumit Gehlot and Nikhil Bhalla, representing the petitioner Advocate Kashif Athar, argued that he is a practicing lawyer in Delhi.

They clarified that it was the petitioner’s brother, Faraz Athar, who had been engaged to the complainant’s daughter, and it was at her own residence that the woman tragically committed suicide.

There are no allegations suggesting that the petitioner (the lawyer) in any way instigated the complainant’s daughter to take her own life.

The Delhi High Court has further listed the matter for hearing on January 9, 2025.
