SC Judge Justice BR Gavai Warns Of Ethical Concerns In Monetising Court Proceedings

Supreme Court Judge Justice B.R. Gavai, who is in line to be the next Chief Justice of India, has raised concerns over the misuse of video clippings from court proceedings by content creators.

Justice Gavai said: ‘I would highlight another concern from the Indian experience. Short clips from court hearings are often circulated on social media, sometimes in a way that sensationalizes the proceedings. These clips, when taken out of context, can lead to misinformation, misinterpretation of judicial discussions, and inaccurate reporting.’

Justice Gavai said that many content creators, including YouTubers, re-upload short excerpts from court proceedings as their own content, which raises serious questions about intellectual property rights and the ownership of judicial recordings.

He pointed out that the unauthorized use and potential monetization of such content create ambiguity between public access and ethical broadcasting.

He was speaking on the topic ‘Leveraging Technology within the Judiciary’ in Nairobi.

He said that need is to establish clear guidelines on the usage of live-streamed proceedings.
