The Supreme Court has recently rejected the petition challenging the Bombay High Court’s order to allow Muslim men to register more than one marriage.
The court said that the petitioner was not a party in the Bombay High Court, hence his petition cannot be heard.
Rashtravadi Shiv Sena president Jai Bhagwan Goyal had filed a petition in the Supreme Court challenging the Bombay High Court order.
What the Bombay HC said?
Earlier, the Bombay High Court had said that Muslim men can register more than one marriage, because their personal law allows them to marry four at a time.
The High Court had given this order on the petition filed against the Thane Municipal Corporation which had refused to register the third marriage of a Muslim man.
Why was marriage registration refused?
Thane Municipal Corporation officials refused to register the marriage on the grounds that the definition under the Maharashtra Marriage Bureau Regulation and Marriage Registration Act covers only one marriage and not multiple marriages. A Muslim man in February 2023 had an affair with an Algerian woman and later on married her.
