MBBS STUDENT’S DEATH: SUPREME COURT ORDERS FURTHER INVESTIGATION BY CBI

The Supreme Court in the case Anadi Dixit vs UoI observed and has directed the CBI to conduct further investigation into unnatural death of an MBBS Student in 2017. In the present case, one Anadi Dixit had lodged the First Information Report after the unnatural death of his daughter who was enrolled in an educational institution pursuing MBBS course.

Therefore, two persons were being arraigned as accused for commission of offences under Section 306, section 201 of the Indian Penal Code, 1860. The said investigation was being handed over to crime investigation division CBCID which has now filed a closure report. In such circumstances, Dixit approached the Apex Court by filing of a writ plea.

The bench comprising of Justice Aniruddha Bose and Justice Sudhanshu Dhuliia observed and has noticed that such developments and also that there are certain other cases of unnatural death, which is being appeared to be the cases of suicide in different institutions within that of the same district. In its order, the bench observed that a young girl has died an unnatural death while pursuing medical studies and two investigating agencies have given reports, one being in the form of charge-sheet for arraigning two individuals as accused and the other filing closure report of the accused.

The court in view of the said fact it appears to be contradiction in the two reports filed by the two investigating agencies and also considering the nature of these cases, this court is of the opinion that further investigation ought to have been undertaken by Central Bureau of Investigation (CBI) and the two investigating agencies shall assist the CBI in this regard.

Further, it has been reported by the Tribunal that over the past three years, six students have been died in this institution campus. Therefore, in the said five accused were alleged to have committed suicide though no suicide note was being found in four cases and one was found dead in his hostel room and the head on the table. The counsel, Senior Advocate Siddartha Dave appeared for the petitioner.
