Haryana Violence: SC Directs Authorities To Prevent Violence/Hate Speech

The Supreme Court declined to impose a ban on nationwide rallies organized by VHP (Vishva Hindu Parishad) and Bajrang Dal.

However, the court issued a direction to police officers to ensure that during the VHP and Bajrang Dal’s protest marches against communal violence in Nuh & Gurugram, no violence or hate speech takes place in various parts of Delhi-NCR.

The plea seeking a ban on VHP-Bajrang Dal rallies in Delhi-NCR was filed by advocates Sanjeev Khanna and S.V. Bhatti. The court has also issued notices to the Delhi government and Haryana government, demanding their response.

Furthermore, the court emphasized that the rallies must remain peaceful, and the administration should ensure that no untoward incidents occur. The court also mandated the recording of video footage during rallies in sensitive areas to safeguard potential evidence.

The bench noted that the Supreme Court had issued orders in October 2022 and April 2023, directing the police to initiate FIRs against hate speech offenses. The court emphasized the importance of adhering to these orders and ensuring their implementation.

Representing the petitioner, senior advocate Chander Singh stated that VHP-Bajrang Dal had announced the thirty-two marches across different parts of the national capital region in protest against the incidents that occurred in Nuh. When the bench asked if any hate speeches were delivered, Singh confirmed that indeed objectionable speeches were made during the rallies held during the day, and plans were made for more rallies in sensitive areas.

Justice Khanna urged Additional Solicitor General S.V. Raju to immediately engage with officials to prevent violence and hate speech and ensure sufficient security personnel, CCTV surveillance, and video recordings to maintain law and order.

The Supreme Court will now hear the case on August 4, 2023, Friday.
