‘Legally Speaking’ has an exclusive copy of the charge sheet filed by the CBI in a Delhi court against several people including Lalu Yadav, daughter Misa Bharti and Rabri Devi in the famous land for job scam case of Bihar.
CBI has alleged in the charge sheet that Lalu Yadav hatched a criminal conspiracy with the connivance of his wife Rabri Yadav daughter and some railway officials and scammed the land for himself and his family members.
The investigation report of CBI has revealed that during the period of 2007-08, Lalu Prasad Yadav had acquired the lands of Village-Mahuabagh, Kunjwa of Patna for making parcel houses. Actually all these lands were adjacent to the parcel house built on the land already owned by the members of his family. Apart from Rabri Debi and Misa Bharti, Mrs. Saumya Raghavan, an officer of the Central Railway, Kamaldir Maun Rai, the General Manager of the Central Railway, had the same name on the land that was earlier near the land that was grabbed from the common people.
Also the then Chief Personnel Officer, and residents of Village Mahjbagh, Patna and Village-Bindaul, Bihta, Patna and Patna City Raj Kumar Singh, Mithlesh Kumar, Ajay Kumar, Sanjay Kumar, Dharmendra Kumar, Vikas Kumar Abhishek Kumar, Ravindra Ray, Kiran Devi, Akhileshwar Singh, Ramashish Singh etc. took land from innocent people and got their names registered in their names instead of offering it to the Railway Khatauni.
The CBI has said that as part of this criminal conspiracy, irregular appointments of candidates were made in violation of the recruitment process in the Railways. In a way, these appointments were given not in exchange of land but in exchange of bribes.
The CBI has written in the charge sheet that the limit has been reached when in the name of job in exchange of land, the prescribed norms and procedures of Indian Railways were grossly violated and irregular appointments were made to all the candidates. For example, the CBI told that the land was bought by Lalu Prasad Yadav and his family-acquaintances and some officers as compensation i.e. at one-fourth of the market value.
The CBI charge sheet states that Lalu Yadav misused his position as Railway Minister and conspired to dishonestly employ railway officials to illegally appoint railway job applicants or land owners and their family members. In this conspiracy, Lalu Yadav misused the powers of the above two officers of Central Railway by force and influence of position. Those who gave land for parcel building were given jobs in Group-D of Central Railway.
CBI has pasted allegations with strong evidence that Lalu Yadav also gave officiating appointments to some people. The candidates who were appointed as officiating were later regularized and in lieu of this appointment, Lalu Prasad obtained the said land in the name of Rabri Devi and Misha Bharti at much lower rates than the circle rates and market rates.
All the candidates admitted as officiating candidates were subsequently regularised. However, he was told that he would be given appointment at railway stations. Lalu Prasad Yadav took the lands of the candidates and their family members and transferred them in the name of his wife Rabri Devi. The price at which Rabri Devi and Misha Bharti had bought these lands was much less than the market price.
CBI has discovered this fact with great difficulty, out of those who had given land worth a penny to Lalu Yadav, Rabri Devi and Misha Bharti, only 9 people got their desired jobs.
Scrutiny has revealed that the same certificates viz., TC of the school and attached with his application, transfer certificate submitted by him during verification, caste certificate were at the same time and in the same format. Residence certificate of one candidate Charmendra Kumar and serial numbers of Sanjay Kumar and Vikas Kumar which show that they have obtained these certificates purely and for a common purpose.
Lalu Prasad Yadav, Misa Bharti, Rabri Devi have been booked under PC Act for criminal conspiracy, cheating, forgery, forgery for cheating and certain sections.
Thus, the above Lalu Prasad Yadav (A-1), Rabri Devi (A-2), Misha Bharti (A-3), Raj Kumar Singh (A-4), Mithlesh Kumar (A-5), Ajay Kumar (A -6), Sanjay Kumar (A-7), Dharmendra Kumar (A-8), Vikas Kumar (A-9), Abhishek Kumar (A-10), Ravindra Ray (A-11), Kiran Devi (A- 12), Akhileshwar Singh (A-13), Ramashish Singh (A-14), Kamaldeep Mainrai (A-15) and Smt. Saumya Raghavan (A-16) etc., IPC Section 120-B read with Sections 420, 467, 468, 471 and Sections 8, 9, 11, 12 and 13(2) read with 13(1)(d) of the Corruption Act, 1988 the original offense has been committed.
The CBI coming out of the charge sheet with these solid evidence means that the sword of arrest can fall on Lalu Yadav, Rabri Devi and Misa Bharti any minute.
