“No Plan To Remove ‘Socialist’, ‘Secular’ From Constitution”: Govt Informs Rajya Sabha

The Central government has clarified that it has no intention to remove or reconsider the terms “socialism” and “secularism” from the Constitution’s preamble.

Union Law Minister Arjun Ram Meghwal informed the Rajya Sabha on Thursday that no formal proceedings have been initiated to amend these provisions.

No Moves To Change Preamble

Responding to a query by MP Ramji Lal Suman, Meghwal said any amendment would require wide consensus and careful deliberation. However, the government has not started any process to alter the words “socialism” and “secularism” at this time.

The Law Minister cited the Supreme Court’s November 2024 judgment in Dr Balram Singh vs Union of India, which upheld the 42nd Constitutional Amendment of 1976 that introduced “socialism” and “secularism.” The Court clarified that “socialism” refers to a welfare state without hindering private enterprise, and “secularism” is a fundamental part of the Constitution’s basic structure.

Public Opinions vs Government Stand

While some social organizations have voiced calls to remove these terms, Meghwal emphasized that such opinions do not represent the government’s official position. He noted these discussions may create public debate but have not prompted any government action.

RSS Leader Questions Inclusion Of Terms

Earlier in June, RSS General Secretary Dattatreya Hosabale described the insertion of “socialism” and “secularism” into the Constitution as forced and called for reconsideration. His comments during the 50th anniversary event of the Emergency were criticized by opposition leaders.

Despite some public debate, the government remains firm that “socialism” and “secularism” will continue to remain part of India’s constitutional identity.
