Sainik Farms Area: PIL In HC On ‘Unauthorised’ Construction

The division bench of Chief Justice Satish Chandra Sharma & Justice Subramonium Prasad today asked the petitioner, how the court can pass an order without hearing property owners.

The PIL was heard before the Delhi High Court alleging unauthorized construction in South Delhi’s Sainik Farms.

Therefore, the bench granted time to the petitioner to implead the owners of the properties, which according to him, have been constructed unauthorisedly and illegally.

Petitioner’s lawyer submitted there is unauthorized construction going on in the Sainik Farms despite several court orders.

During the hearing, the bench stated that “You want us to pass an order to demolish the properties without hearing the parties? You should implead the persons whose properties are mentioned in the petition.” As the counsel said he does not have information about the property owners and it would be difficult for him to identify the persons, the court said, “It would be very difficult for us to pass orders behind someone’s back. You have filed a PIL, do some homework.” The council then sought some time to implead all those persons whose properties have been mentioned in the plea and the court listed it for further hearing on July 24.
