Thane MACT Awards ₹18.84 Lakh To Family Of Motorcycle Accident Victim

The Motor Accident Claims Tribunal in Thane, Maharashtra, has awarded a compensation of Rs.18.84 lakh to the family of Vishwanath Dnyaneshwar Mahajan, who was tragically killed in a motorcycle accident in 2020.

The tribunal, chaired by S.B. Agrawal, ordered the motorcycle’s owner and its insurer to pay the compensation jointly and severally, with an interest rate of 7.5% from the date the claim was filed.

The order, made public on October 21, came after the deceased’s father and sister, both residents of Ambernath, filed the claim. The owner of the motorcycle did not appear in court, leading to a decision made ex parte against him.

The petitioners’ counsel, V.D. Gupta, informed the tribunal that Mahajan worked as a knowledge process outsourcing officer, earning Rs.17,000 per month. On September 19, 2020, while riding his motorcycle, he was struck by a speeding two-wheeler and died at the scene.

In its ruling, the tribunal awarded Rs.18.84 lakh in total, which includes Rs 40,000 for loss of filial consortium and Rs.15,000 each for loss of estate and funeral expenses.

The tribunal instructed the insurance company to disburse the compensation to the petitioners first, after which it could recover the amount from the motorcycle owner.

Additionally, the tribunal mandated that Rs.12 lakh be invested in fixed deposits in the name of the deceased’s father and Rs.6 lakh in the name of his sister.
