Delhi’s Rouse Avenue court on Friday directed the Central Bureau of Investigation (CBI) to submit an affidavit in response to a petition filed by Christian James Michel, an accused in the AgustaWestland Chopper scam case. Michel is seeking the list of “un-relied” documents received from the United Kingdom.
The CBI obtained certain documents related to the accused through rogatory channels, and while the charge sheet has been provided to the accused, the list of “un-relied” documents has not been furnished.
Special CBI Judge Arvind Kumar has directed the CBI to file the affidavit by November 2, and the application will be heard on November 3. The CBI’s counsel had previously argued that the list of un-relied documents could not be provided to the accused.
The application was submitted by Michel’s counsel, Aljo K Joseph. The CBI has already filed a response opposing the plea, and now the court has instructed the agency to file an affidavit.
In response, advocate Joseph emphasized that the accused has been in custody since December 2018, and the investigation has been ongoing for ten years. Michel was extradited from the UAE on December 4, 2018.
