Allahabad HC Orders Kundali Submission To Decide Mangalik Status In Rape Case Bail Plea With Promise Of Marriage

Allahabad High Court has recently Ordered Lucknow University’s Astrology Department to Examine Woman’s Kundali to Determine Mangalik Status in Bail Plea Hearing for Rape Case with Alleged Pretext of Marriage.

The accused argued that the marriage could not have been solemnized as the woman is mangalik, and therefore, unfavourable for marriage. A person is considered mangalik as per Hindu astrology if they are born under the influence of Mars, and have mangala dosha, which is considered inauspicious for marriage.

The High Court directed both parties to submit their kundalis to the head of the Astrology department of Lucknow University, who was asked to produce a report on the mangalik status of the woman.

The report was directed to be submitted to the court within three weeks in a sealed cover.

Representing the applicant were Ravindra Kumar Singh, Anjali Dubey, Manoj Kr. Singh, Rajiv Mishra, Soniya Mishra, and Soni Pathak, while the prosecutrix was represented by advocate Vivek Kumar Singh.

The court order analysed the validity of rape charges in cases where the promise of marriage was made, stating that such cases should be treated as a breach of promise to marry rather than rape.
