The Delhi High Court on Friday barred AAP leaders Sanjay Singh, Dilip Kumar Pandey, Saurabh Bhardwaj, and Durgesh Pathak from making defamatory allegations against Former BJP vice president Shyam Jaju and his son Sandesh Jaju.
In a press conference on January 22, AAP leaders claimed that Delhi BJP leader Adesh Gupta and Shyam Jaju’s son had made illegal earnings through a company called Majboot Solutions Private Limited.
The lawsuit claims that the press conference was live streamed on internet platforms and is still available to the general public. It further states that print and digital media outlets have repeated and spread the allegedly defamatory claims.
The victim, Shyam Jaju, served a legal notice to AAP leaders, demanding withdrawal of the allegations leveled against his son and removal of all references to social media.
The suit was filed through advocate Samapika Biswal and the arguments were led by Senior Advocate Mahesh Jethmalani.
Single Bench of Justice Navin Chawla passed an interim order directing AAP leaders to remove such social media posts and prohibited them from making any further allegations against Jaju and his son. The Court held that there was a prima facie case made out for granting interim relief.
The order stated, “Defendants 1-4 are directed to remove the defamatory content relating to the plaintiffs within two days, failing which defendants 5-17 (social media intermediaries and digital portals) are directed to remove it after notice. Defendants are further ordered to prohibit themselves from publishing or disseminating any further defamatory content about the plaintiffs.”
