BJP MP Bansuri Swaraj’s Counsel Calls Satyendar Jain Defamation Case ‘Politically Motivated’

In a significant development in the defamation case filed by former Delhi Minister Satyendar Jain against BJP MP Bansuri Swaraj, the latter’s counsel has argued in the Rouse Avenue Court that the defamation complaint is politically motivated.

The defence claims that the complaint is being used for electoral purposes, alleging that Jain is leveraging the case to target her and gain political mileage. Jain, currently in custody, had his bail applications rejected by the court.

Satyendar Jain, an Aam Aadmi Party leader, has accused Bansuri Swaraj of tarnishing his reputation through remarks made during a television interview. The interview, which aired on October 5, 2023, was viewed by millions. In his complaint, Jain claims that Swaraj falsely stated that a substantial amount of money and gold were recovered from his house during an Enforcement Directorate (ED) raid. She allegedly claimed that Rs. 3 crores, 1.8 kg of gold, and 133 gold coins were seized from his property.

Jain further accuses Swaraj of making defamatory statements by calling him “corrupt” and a “fraud.” These allegations, he argues, have caused significant damage to both his public and personal reputation. The former Delhi Minister claims that the false and malicious remarks have severely impacted his credibility, both as a politician and as an individual, affecting his relationships with his family, friends, and society at large.

The case has garnered significant attention, with Jain asserting that the allegations have led to a smear campaign against him, damaging his unblemished political career. His counsel has stressed that the reputational harm caused by these false claims is immeasurable, and the defamatory statements have led to a cascading effect on his personal and professional life.

On December 16, 2023, the court issued a notice to Bansuri Swaraj regarding the defamation complaint. Advocate Siddhesh Kotwal represented Swaraj during the hearing. Jain’s legal team, led by advocates Rajat Bhardwaj and Mohd. Irshad, has also filed a civil defamation suit against Swaraj. The Rouse Avenue Court, after hearing the submissions, has adjourned the matter for further proceedings on January 22, 2025.

This legal battle revolves around the claims made in Swaraj’s televised interview, where she made strong accusations related to an ED raid at Jain’s residence. Jain, who is currently out on bail, has rejected the accusations, asserting that the allegations are fabricated and politically motivated.

The court had earlier directed that Jain be allowed to present pre-summoning evidence in support of his defamation complaint. As the case continues to unfold, both sides remain engaged in a tense legal battle, with significant implications for the reputations of those involved.
