Bombay HC Quashes FIR Against Indian Cricket Team’s Ex-Physiotherapist In Cheating Case

The Bombay High Court has recently quashed an FIR and proceedings in a lower court in Mumbai against Dr Ali Irani (former physiotherapist of the Indian cricket team), and his business partner Mehmood Usman Ali in a cheating case.

Both had been accused of cheating Bollywood film producer Vijay Mulchandani. The case had come to an end with the consent of Mulchandani after settlement talks began.

Mulchandani claimed that he entered into an agreement with Dr Irani and Ali- both owners of Don OTT- wherein he sold the rights of his 2019 movie ‘Yaaram’ to Don OTT for Rs 1.25 crore. The movie started streaming on the platform in March 2020.

However, producer Vijay Mulchandani stated that the owners of Don OTT never paid the full amount owed to him despite multiple reminders. The complainant stated, some of the cheques were also dishonoured.

Advocate Rajiv Patil for Dr. Irani and advocates Urmila Pulekar and Ali Kaashif Khan for Ali and advocate Shirish Shigwan for Mulchandani appeared before the bench of Justices Ajay Gadkari and Sharmila Deshmukh and submitted that all of them have resolved their differences and disputes and have settled the matter amicably out of Court.

Mulchandani stated that he had no grievance against Dr Irani and Ali and gave no objection to quashing the case.

Furthermore, the court directed that both the accused, Dr Irani as well as Ali to pay Rs 1 lakh each to the Tata memorial hospital within 2 weeks for wasting court time. The court specified that if the cost is not paid, then the petition against them will stand revived.

Now, Dr Irani and Ali will have to report to the high court by October 12 that they have complied with the order and paid the cost.
