CALCUTTA HIGH COURT: RESTRAINING UOI FROM DEPORTING 4 ROHINGYA MUSLIM WOMEN TO MYANMAR TILL AUGUST 10

The Calcutta High Court in the case Fatema Begum & Ors. vs. UOI observed and as restrained the Union Of India from deporting 4 Rohingya refugee women to Myanmar till August 10.

The bench comprising of Justice Moushumi Bhattacharya further directed that the 4 women should be provided with facilities that are commensurate to their right to live with dignity.

In the present case, the court was dealing with a petition filled by 4 women who have served their period of detention on 20th July, 2019, therefore, they continued to remain since then in the Dumdum Correctional Home.

In the writ petition, it was prayed by them a direction on the respondent authorities not to deport them to Myanmar. It was also submitted by them before the court that they have received verbal communication from the jail authorities that they shall be deported to Myanmar on 5th August 2022.

Further, it was submitted by the counsel appearing for the Union Of India and as well as the Government Pleader that they do not have any instructions of any such order of deportation.

However, the court directed that until the matter is taken up for hearing by the Court, the respondents shall not give any effect to any order of deportation of the four petitioners and if any such order has been made after filing of the writ petition, till further orders are passed in the matter.

The court listed the matter for further hearing on 10th August, 2022 and the petitioners were directed to file a supplementary affidavit bringing the subsequent events on record before the returnable date and the advance copy of the same and serve on the counsel appearing for the respondents.

Accordingly, in the meantime, the court directed the respondent authorities that the petitioners be provided with facilities that are commensurate to their right to live with dignity.
