Transgender councillor Bobi Kinnar has been granted anticipatory bail by the Rohini Court in a caste certificate case.
The court provided interim protection to Bobi on August 17, noting that the case is based on documents and there’s no risk of witness tampering since the witnesses are government officials.
An FIR was filed against Bobi at Sultan Puri police station, prompting him to seek anticipatory bail. Additional Sessions Judge (ASJ) Kapil Kumar granted the bail, emphasizing that the case primarily involves documentary evidence, which is official and cannot be tampered with.
The court stated, “Prima facie, there is no scope of threatening the witnesses,” and noted that there is no need for custodial interrogation at this stage of the investigation. As a result, the court ordered that no coercive action should be taken against Bobi until the next hearing on September 10.
Bobi has joined the investigation and will continue to cooperate as required. The court also allowed the investigating officer (IO) to file additional replies regarding any developments in the investigation and any future need for custodial interrogation.
During a recent hearing, the IO appeared via video conference, stating that he would first verify Bobi’s caste certificate and then take appropriate legal steps. He assured that Bobi would not be arrested until Tuesday.
Bobi’s lawyer, Amit Kumar, argued that the FIR was falsely registered by the complainant, Varuna Dhaka, who had lost the 2022 MCD election to Bobi. The lawyer also mentioned that a complaint has been filed against the complainant, and an inquiry is being considered.
