Chief Justice of India DY Chandrachud on Tuesday said that the coming next week will be a miscellaneous week in the Supreme Court as the case related to Shiv Sena dispute was mentioned for urgent listing next week.
The CJI further said that since it’s a Constitutional Bench mark, it can’t be heard in next miscellaneous week. “It won’t be possible to assemble 5 judges on a miscellaneous week”, CJI said.
Mondays & Fridays are said to be as a ‘miscellaneous days’ in Supreme Court that states that the fresh petitions will be taken up on those days for admission hearing and regular hearing matters won’t be heard. And the regular hearing matters will be heard on Tuesday, Wednesday & Thursday, that are known as ‘non-miscellaneous days’.
When a whole week is considered as “miscellaneous week” that means the court will hear all the miscellaneous matters all days of the week with no regular hearing taking place. The final week before vacations and the first week upon reopening are typically designated as “miscellaneous days.”
Before the Supreme Court closes for winter vacations, December 12- 16 is the last week. The Court will reopen on January 2, 2023.
