Congress leader and Member of Parliament Rahul Gandhi was granted bail on Tuesday by a Lucknow court in connection with a defamation and sedition case filed over remarks he made about the Indian Army and central government in 2018.
The case was filed by Lucknow-based advocate Nripendra Pandey, who alleged that Gandhi’s comments during a public rally in Bengaluru on May 8, 2018, were derogatory toward the Indian armed forces and accused the government of politicizing the military.
Gandhi appeared in person before the court following a summons issued earlier this year. After brief arguments from both the prosecution and the defence, the court accepted his bail plea, ordering his release upon submission of personal and surety bonds.
The bail was granted by the court of Special Judicial Magistrate at Patiala House, with the order issued after considering the submissions from both sides.
Advocate Nripendra Pandey’s complaint claimed that Gandhi’s 2018 speech included remarks suggesting the central government was using the Indian Army for political gains, which he argued could lower public trust in the military. He also alleged that such statements were designed to mislead citizens and stir public discontent, amounting to offences under Sections 124A (sedition) and 505 (public mischief) of the Indian Penal Code.
The court had taken cognizance of the complaint in December 2023 and, after concluding that a prima facie case existed, issued a summons for Gandhi to appear.
Gandhi’s legal team maintained that his comments were made in a political context and fall within the ambit of free speech protected under Article 19(1)(a) of the Constitution. They argued that the statements were neither inflammatory nor intended to incite violence or hatred.
On the other hand, the complainant insisted that a senior political leader like Gandhi carries immense influence, and such remarks could harm public perception of the armed forces.
Legal & Political Context
This case adds to a series of legal challenges faced by Rahul Gandhi in recent years, often related to his sharp criticism of the BJP-led central government. The use of sedition laws, particularly Section 124A, has become a contentious legal issue, with several ongoing debates over its relevance in a democratic society.
Gandhi’s bail now ensures he remains free as the case progresses through further hearings. The next date in the matter is expected to be announced shortly.
