Citing significant delays in the trial, a Delhi court has approved bail for an accused involved in a robbery case.
Vacation Judge Aparna Swami considered the Supreme Court’s judgment, which highlights trial delay as a crucial factor in bail decisions. Judge Swami emphasized “There is no other involvement of the present accused. Trial will take substantial time. No purpose will be served in keeping the accused in custody… In view of the same, accused Sagar is admitted to bail.”
The bail was granted upon the submission of a bond worth Rs 50,000, along with a local surety of the same amount.
Additionally, the judge ordered the accused to cooperate with the investigating officer during the investigation and prohibited the accused from leaving Delhi without court permission. The order, issued on June 12, also emphasized that “accused shall not try to tamper with evidence or influence the witnesses”.
The accused was apprehended in a case filed under multiple sections of the Indian Penal Code (IPC), which encompassed 392 (robbery) and 411 (dishonestly receiving stolen property).
The accused had been in custody since March 11, and the charge sheet for the case had already been filed. Although the prosecution opposed the bail application, the court granted bail considering the trial delay.
