Delhi Court Acquits Neeraj Bawana and Ors in MCOCA Case

The Rouse Avenue Court in Delhi recently acquitted Neeraj Sehrawat, also known as Neeraj Bawana, along with his brother Pankaj Sehrawat, maternal uncle and former MLA Rambeer Shokeen, and other accused in a case filed under the stringent Maharashtra Control of Organised Crime Act (MCOCA) eight years ago.

The Special Cell of the Delhi Police had filed this case in 2015. Despite this, the court found Shokeen guilty of failing to appear before the court even after a proclamation was issued against him.

Judge Geetanjali Goel of the Special MP-MLA Court acquitted the accused—Pankaj Sherawat, Neeraj Sehrawat alias Neeraj Bawana, Naveen Dabas alias Bali, and Rahul Dabas alias Kala.

The court directed the acquitted accused to provide a bail bond as per the conditions of Section 437-A of the Code of Criminal Procedure (CrPC).

The court granted time for this and scheduled the next hearing for August 26. Except for Rambeer Shokeen, the accused must be released immediately if they are not wanted in any other case.

Additionally, the court directed the state to submit an affidavit detailing the expenses incurred by the prosecuting agency within two days, following the judgment of the Delhi High Court in the case of Karan vs. State NCT of Delhi.

The court further stressed the need for expeditious disposal of the matter, considering it pertains to an MLA.
