Delhi Court Calls For ‘ATR’ From Police On Plea Filed By Bina Modi’s PSO Against Samir Modi

Delhi’s Saket Court has called for an Action Taken Report (ATR) following a plea by industrialist Bina Modi’s Personal Security Officer (PSO) against her younger son, Samir Modi.

The PSO, Surender Prasad Ram, sought the registration of a non-cognizable report and an investigation into allegations against Samir Modi.

Surender Prasad Ram, who served the CRPF for 20 years and the NSG for two years, is currently working as Bina Modi’s PSO. Metropolitan Magistrate Aridaman Singh Cheema directed the Delhi police to file an ATR, scheduling the next hearing for July 12.

Ram’s application calls for an investigation into the alleged offences committed by Samir Modi, citing sections 323 (voluntarily causing hurt), 352 (assault or use of criminal force otherwise than on grave provocation), and 506 (criminal intimidation) of the Indian Penal Code. Senior advocate Vikas Pahwa, along with advocate Ronak Singh, represented Ram in court.

Pahwa argued that despite 2 complaints were filed on May 31 and June 4, 2024, with Sarita Vihar police, no action has been taken. In contrast, the police lodged an FIR based on Samir Modi’s complaint regarding an incident on May 30, 2024, at the office where Ram was posted at the meeting room gate.

Hearing Of The Case

During the hearing, CCTV footage of the incident was shown in the courtroom, featuring both Samir Modi and PSO Ram. According to the application, on May 30, 2024, Ram was stationed at Godfrey Phillips India Ltd.’s (GPIL) office in Jasola, New Delhi, where a meeting was underway in the “Cavanders” meeting room.

The plea stated that around 12:00 PM, Samir Modi tried to enter the meeting room, which was closed at the time. Ram respectfully intervened, requesting permission from those inside the room for Modi to enter. This action allegedly enraged Samir Modi, leading to verbal abuse, physical assault, and threats against Ram.

The CCTV footage reportedly corroborates Ram’s account, showing him remaining calm and repeatedly requesting permission for Modi’s entry. The application asserts that Ram has suffered physical and mental harm due to Samir Modi’s actions and fears for his well-being.

Despite filing a complaint with Sarita Vihar police for an NCR, no action was taken. In contrast, an FIR was filed based on Samir Modi’s complaint, alleging that Ram assaulted him on May 30, 2024, resulting in Modi being hospitalized with a grievously injured index finger.
