Delhi Court Denies Bail To Naresh Balyan MCOCA Case

AAP MLA Naresh Balyan, accused under the Maharashtra Control of Organised Crime Act, was denied bail by a Delhi court on Wednesday.

Balyan, the Uttam Nagar MLA, was arrested on December 4 and has been in judicial custody for his alleged involvement in a case linked to gangster Kapil Sangwan, also known as Nandu.

Special Judge Kaveri Baweja dismissed Balyan’s bail application, with the Delhi Police arguing that he could influence witnesses, destroy evidence, and obstruct the investigation if released. Special Public Prosecutor Akhand Pratap Singh stated, “They (witnesses) have confessed that accused Naresh Balyan is a facilitator/conspirator in the organised crime syndicate of Kapil Sangwan and provided money to one syndicate member after the commission of a crime to cover expenses while evading arrest.”

The prosecutor further highlighted that the crime syndicate, led by Sangwan, had “created havoc in society and amassed huge illegal wealth,” citing 16 FIRs filed against its members across Delhi. Balyan’s alleged connection to the syndicate came under scrutiny after an audio clip of a conversation between him and Sangwan surfaced last year. Delhi Police claimed that Balyan collaborated with Sangwan, who has been involved in multiple extortion and shooting cases in the city.

Opposing Balyan’s bail plea, the police described him as a “facilitator” in the organised crime syndicate. On January 9, after hearing arguments from both the prosecution and the defense, the court reserved its decision, ultimately rejecting the plea.

According to a media report, earlier in the day, the court issued a notice to the Delhi Police after Balyan filed a petition seeking permission to sign documents required to open a bank account and complete formalities necessary to contest the upcoming Delhi Assembly elections.
