A Delhi court is expected to deliver its decision on Wednesday regarding the regular bail application filed by Jammu and Kashmir Lok Sabha MP Engineer Rashid in a terror funding case.
The hearing will also address whether the case should be transferred to the designated MP/MLA court.
Additional Sessions Judge Chander Jit Singh, who had initially scheduled the order for Tuesday, deferred it to November 20. The court previously reserved its decision on Rashid’s bail while examining jurisdictional issues related to transferring the case to a special court.
Rashid, representing Baramulla in Parliament, surrendered to Tihar jail authorities on October 28 following the expiration of his interim bail. The court granted him interim bail on September 10 to allow him to campaign for the Jammu and Kashmir Assembly elections.
The bail was subsequently extended due to his father’s ill health, a plea the National Investigation Agency (NIA) did not oppose after verifying the related documents.
The case dates back to 2019 when Rashid was arrested by the NIA under provisions of the Unlawful Activities (Prevention) Act (UAPA) in connection with a 2017 terror funding investigation. He has been in Tihar jail since his arrest.
Jammu and Kashmir recently concluded its 90-member Assembly elections, held in three phases between September 18 and October 1. Rashid’s interim bail period coincided with the election campaign period, and he played an active role.
On October 8, the National Conference-Congress alliance emerged victorious, securing 48 seats.
The upcoming court decision will determine Rashid’s immediate future, as well as the jurisdiction under which his case will proceed.
