Delhi HC: Petitioner Who Made “Wild Allegations” Against Judicial Official Apologises, Withdraws Petition

A petitioner who filed a petition against a judicial official and made “wild allegations” tendered his unconditional apology and also consented to file an undertaking before the Delhi High Court that he will not file any other frivolous lawsuits in future.

A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad noted the petitioner’s statement that such undertaking will be filed within seven days and permitted the petitioner to withdraw the plea.

The Court was hearing a petition filed by a man called Dinesh Kumar seeking a direction to the Registrar General of the High Court to decide his complaint made against a judicial official on December 29, 2022.

The bench noted that the petitioner had also made some other “wild allegations” against the officer in the petition.

The bench also noted that the petitioner had already challenged the officer’s order on the judicial side after considering the case.

The court further observed that a committee of three judges had already looked into the petitioner’s allegation and that his request to file a suo motu proceedings against the officer had been denied.

“Confronted with this, the petitioner truly indicated before this Court that he is tendering an unqualified apologies for filing the current petition since he has previously contested the order given by the judicial officer on the judicial side,” the Court noted.

The petitioner’s request to have the plea dismissed was then granted. The petitioner appeared in person.
