The Delhi High Court in the case Nihal Ahmed vs State (GNCD) observed and has granted interim bail for a period of ten days to the accused in an Arms Act case for allowing him to arrange money for paying daughter’s admission fee for LLB Course.
The bench comprising of Justice Talwant Singh observed and has stated that the interim bail shall not be extended under any circumstances and the petitioner Nihal Ahmed shall surrender once the period of ten days is over.
However, the court stated that while keeping in view the fact that the petitioner has to make arrangements for making payment of admission fees of his daughter and that the family should not suffer for his acts, the court is inclined to grant him interim bail for a period of ten days from the date of his release, on execution of personal bond of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned court.
In the present case, Ahmed had approached seeking interim bail in a 2011 FIR registered under section 452, section 325, section 506, section 34 of the Indian Penal Code, 1860 and under section 25, section 27, section 54, section 59 of the Arms Act, 1959 at Gandhi Nagar police station. Thus, a chargesheet has already been filed in the case.
The prosecution while opposing the plea submitted that he had been declared a proclaimed offender in the case and thereafter, he was arrested. It has also been stated by the prosecution that he was involved in another case also.
Further, it has been submitted by the counsel appearing for the accused that the last date for payment of admission fees for LLB course to be pursued by his daughter is November 15.
The court was informed by Advocate Rajni Kant, the petitioner has to make arrangements for making payment of admission fees as he is in judicial custody for the last about 9 months.
