The Delhi’s Rouse Avenue Court on Friday ordered the filing of charges against Aam Aadmi Party (AAP) MLA Amanatullah Khan and 24 others for allegedly disrupting a South Delhi Municipal Corporation (SDMC) anti-encroachment drive in the Madanpur Khadar area of Delhi.
While issuing the order, Additional Chief Metropolitan Magistrate (ACMM) Harjeet Singh Jaspal stated, “Prima facie there is sufficient material on record to frame charge u/s 147/ 149/ 153/ 186/ 353/ having taken into account the totality of the facts and circumstances, the documents placed on record by the prosecution, the complaint filed u/s 195 CrPC, the MLCs of the injured police personnel, the statements u/s 161 Cr.
According to Delhi Police, the accused formed an unlawful assembly with the goal of discouraging public servants from carrying out their duties, resulting in stone pelting and violence against public servants. The accused members of the unlawful assembly created violence, hurt public employees, and destroyed public property. The charge sheet has been submitted in accordance with sections 147, 148, 149, 153, 186, 332, and 353 of the IPC.
However, the Court discharged eight accused after determining that there was insufficient evidence to frame charges against them.
On May 12, 2022, South Delhi Municipal Corporation was supposed to conduct a demolition operation in the vicinity of Kunchan Kunj and Kalindi Kunj, according to the police.
Amanatullah Khan, a local MLA, arrived at the scene as the demolition work was still being done with the help of his supporters and other individuals, and they immediately began making a scene.
According to the prosecution, the accused gathered the local public, and the crowd gradually grew to a large assembly. This crowd attempted to reach the demolition site but were stopped by the Delhi Police security arrangement.
As stated by the prosecution, the accused, who were part of the crowd, began pushing the police and attempting to stop the demolition. When the police used a loudspeaker to calm the throng, the crowd turned hostile and began throwing stones.
