DHC: Review Petition Rejected Against Appointment Of Justice DY Chandrachud As CJI

Delhi High Court

The Delhi High Court on Monday dismissed a review petition challenging Justice DY Chandrachud’s appointment as Chief Justice of India.

A bench of Justices Sanjeev Sachdeva and Vikas Mahajan while dismissing the plea imposed 1 lakh costs on the petitioner, Sanjeev Kumar Tiwari.

The Delhi High Court in its order said that “No ground is made out to review the order dated 11 November. The review petition is dismissed.

The bench also observed that It appears that the review petition has been filed in the guise of seeking a re-hearing of the petition which is not permissible in review. Accordingly, the petition is dismissed,” the Court added.

The review petition was filed in response to a High Court order dated November 11, 2022, in which the petition challenging the appointment of CJI Chandrachud was dismissed with ₹ 1 lakh costs.

The petitioner claimed that he was not given a copy of the November 2022 order in Hindi, which he said was unconstitutional. “This order is unconstitutional. I wasn’t given a Hindi copy of the order,” the petitioner said.
In November, a bench comprising Chief Justice Satish Chandra Sharma and Justice Subramaniam Prasad dismissed the petition, observing that it has now become fashion to approach courts with scandalous.
