A man from Gujarat’s Banaskantha filed a petition in the High Court seeking custody of his girlfriend, who was married to another man. Irked by the plea, the Gujarat High Court fined the petitioner Rs 5,000, alleging that he has no locus standi in the matter.
On the basis of their living-in agreement, the guy claimed custody of his girlfriend from her husband. The petitioner was apparently in a relationship with the lady he claimed was married against her will.
The lady left her husband and marital home to live with the petitioner, after which they lived together. liveThey later signed a live-in relationship arrangement.
The High Court bench of justices VM Pancholi and HM Prachak stated that because the lady had not divorced her husband, custody could not be granted based on a live-in relationship arrangement.
