The Madhya Pradesh High Court recently directed the Law Secretary, Bhopal to take steps regarding the appointment of incompetent public prosecutors and government advocates in the State.
While hearing a bail plea, Justice Deepak Kumar Agarwal expressed his surprise at facing difficulties while hearing cases because of incompetent state counsel.
The order stated that “It is a matter of surprise that this Court is facing various difficulties while hearing the matters because incompetent Public Prosecutors/Government Advocates are being appointed by the State Government who are not properly arguing the matters and assisting the Court in the helpful manner listed day to day basis.”
Thus, the observation came while the single judge was hearing an anticipatory bail application of a rape accused.
The survivor alleged that she was taken to Jhansi on the false pretext of marriage by one Sunil Rawat and his friends, one of whom was the applicant. The main accused allegedly took her to Raipur where he rented a room & sexually assaulted her.
Thereafter, he refused to marry her.
The applicant’s counsel submitted that he got falsely implicated in the case. It was stated that the only allegation against the applicant was that he went to Jhansi along with the survivor and accused and left them at the railway station.
The State’s counsel vehemently opposed the bail application and prayed for its rejection.
Considering the facts, the applicant was granted anticipatory bail on furnishing a personal bond of ₹25,000 with one solvent surety in the like amount.
