Justice Served: Woman Convicted for False Rape Accusation, Faces ₹5.9 Lakh Fine

In a recent verdict in State of Uttar Pradesh v. Nisha in Bareilly, Uttar Pradesh, a woman was found guilty of falsely accusing a man of rape in 2018. Additional District Judge Gyanendra Tripathi sentenced her to 4 years, 6 months, and 8 days of imprisonment, equivalent to the time the man spent in jail due to her false accusation.

The court also imposed a fine of approximately ₹5.9 lahks on the woman, to be paid to the man she falsely accused. It warned that failure to pay the fine would result in an additional 6 months of imprisonment for the woman.

The court emphasized that while it’s crucial to ensure women’s safety through government policies and laws, it doesn’t justify unfair attacks on men’s interests. It stressed the importance of holding guilty individuals accountable, as their actions can harm genuine victims in society.

Consequently, the court deemed it appropriate to punish the proven culprit with severe consequences.

In 2018, Ajay Kumar, also known as Raghav, was accused of kidnapping and raping his colleague’s sister, who was 15 at the time. Initially, she stated to the police and the magistrate that Ajay had molested her.

However, during cross-examination, she admitted to intentionally lying and confirmed she was never molested or raped by Ajay. As a result, the Court initiated prosecution against her under Section 195 of the Code of Criminal Procedure, 1973.

The Court found no evidence of assault and noted that Ajay had been falsely implicated due to the woman’s false statement. He had been in detention for over 4 years. The Court emphasized that while it takes women-related complaints seriously, it’s unacceptable for women to misuse laws meant for their protection, violating men’s rights.

Consequently, the woman was convicted of malicious prosecution.
