Kerala HC Directs State To Review CBSE SMA Representations On Proposed Fee Regulatory Committee

The Kerala High Court recently directed the State government to reconsider the representations challenging the formulated guidelines by the Director of General Education (DGE) regarding the establishment of a fee regulatory committee and fee determination in CBSE/ICSE affiliated and unaided schools following the Kerala State syllabus.

A single judge Justice P.V. Kunhikrishnan passed the order and further directed the State to make appropriate decisions within three months, after granting the petitioners an opportunity to present their case.

During the hearing of the two writ petitions filed by (Kerala CBSE Schools Management Association & Ors) challenging the DGE’s proposed guidelines, the petitioners’ counsels informed the Court that they had already submitted representations expressing their concerns to the State Government. They requested the Court to direct the State to consider these representations.

At this point, the Senior Government Pleader Nisha Bose informed the bench that the Government had not made any decision regarding the issuance of an executive order or legislation after receiving the DGE’s guideline for the establishment of a Fee Regulatory Committee.

“If that be the case, I am of the considered opinion that, before proceeding further, the representations submitted by the petitioners also can be considered,” Justice Kunhikrishnan Stated.

As a result, the writ petitions were disposed of.
