Kerala High Court seeking personal appearance of KM Shahjahan in contempt case: Youtube video against HC Judges

The Kerala High Court in the case Suo Motu v. K.M. Shajahan observed and has directed K.M. Shajahan, the then private secretary of the former Chief Minister of Kerala V.S. Achuthanandan for appearing in person before the Court in the proceedings which are initiated against him for suo motu contempt and for making of a serious allegations in a YouTube video against the judges of High Court.
The Division bench comprising of Justice Anil K. Narendran and Justice P.G. Ajithkumar in the case observed and has directed the issuance of an urgent notice to Shajahan wherein asking him to appear before the Court on 03.13.2023.
The said matter was listed on February 3 before another Division Bench. The High Court Registrar General filed a plea seeking criminal contempt wherein it is alleged that Shajahan had made serious allegations against the Judges of the High Court in the speech given by him and is being available in the YouTube video channel named ‘Prathipaksham’. Therefore, the speech pertaining to an Advocate for taking money from the clients under the pretext of bribing judges. Thus, the allegations made by Shajahan’s were that some Judges of the High Court were also been involved in the said incident wherein it has been alleged to be contemptuous and scandalising the judiciary.
It has been directed by the Registry on 08.02.2023 to a copy of the contempt case on the Advocate General, as it is being stipulated under Rule 8A of the Rules under the Contempt of Courts Act, 1971.
The court observed while considering the contents of the words spoken by Sri.K.M.Shajahan, who is being arrayed in a YouTube video channel ‘Prathipaksham’ as the respondent, wherein serious allegations which are made against the learned Judge of this Court, in connection with the incident in which Sri. Saiby Jose Kidangoor, who being an Advocate of the said Court for taking money allegedly to bribe three learned Judges of this Court and the submissions the learned Senior Government Pleader who made the submissions before the court, the said court is being satisfied that a prima facie case has been made out under sub-clause (i) and the sub-clause (iii) of the clause (c) stated under Section 2 of the Contempt of Courts Act, 1971.
Accordingly, the court listed the matter to be next heard on 13.03.2023.
