MLAs Poaching Case: Telangana Govt Filed SLP in SC Against HC Order

The Telangana Government filed SLP in Supreme Court against the Telangana High Court’s order.

Earlier, the Telangana High Court ordered transferring of the poaching case of 4 Bharat Rashtra Samithi (BRS) MLAs to the Central Bureau of Investigation (CBI).

The matter was mentioned before a bench of Chief Justice DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala.

Appearing for the State Government, Advocate Dushyant Dave submitted, “I am mentioning on behalf of State of Telangana. There was an FIR regarding destabilising the government. The writ petition was filed and the single judge, after recording that request to transfer to CBI had been conceded by their own lawyers, transferred it to CBI. We went to a Division Bench. Division Bench said that the LPA was not maintainable, although the bench was asked to grant protection and requested for CBI to not enter. There is a grave urgency. If CBI enters the investigation, everything will fail.”

CJI DY Chandrachud asked Senior Attorney Dave to bring the matter up again tomorrow.

“We will list the matter. Mention it tomorrow morning. You don’t have to come, ask a junior to mention and we will list it accordingly. Even without mentioning, it will come up next week, CJI stated.

What is the MLA poaching case?

Three people, Ramachandra Bharati aka Satish Sharma, Nandu Kumar and Simhayaji Swamy were named as accused in the case after a complaint was lodged by BRS MLA Pilot Rohith Reddy, among four legislators, against them on October 26,2022. The trio was arrested while they were allegedly trying to lure four MLAs of the ruling BRS to join the BJP. Subsequently, they were granted bail by the Telangana High Court.

As per the FIR copy, Rohith Reddy alleged that the accused offered him Rs 100 crore and in return the legislator had to leave BRS, and contest as a BJP candidate in the next Assembly election. They had allegedly asked Reddy to bring more BRS MLAs by offering RS 50 crore each to join the BJP.
