An MP/MLA Court in Bihar’s Patna district has recently ordered Congress Leader Rahul Gandhi to appear before it on April 12 to record his statements in the Defamation case brought against him by Rajya Sabha MP Sushil Kumar Modi under Section 313 CrPC.
MP Modi filed a criminal complaint against Gandhi in 2019 (via Senior Advocate and former Additional Solicitor General of India SD Sanjay) under Section 500 of the Indian Penal Code (IPC) (Defamation) for his alleged remark “why all thieves share the Modi surname” during a political campaign in Karol in April 2019. It is his case that it was a derogatory remark directed at individuals with the surname “Modi.”
Gandhi was granted bail in the lawsuit in 2019.
It should be noted that on March 23, a court in Surat, Gujarat, convicted Gandhi in a similar defamation case brought against him over this very statement, and he was disqualified as a Lok Sabha MP as a result.
Several witnesses have already testified in court on Sushil Modi’s behalf, including the then-road construction minister of Bihar, Nitin Nabin, the president of BJYM Bihar, Manish Kumar, senior advocate SD Sanjay, Senior Advocate Subodh Jha, Advocate Arjun Kumar, and Advocate Ratnesh Kumar.
Gandhi has now been summoned to appear in person before the Court in order to record his statements.
