Mumbai Court Unaware Of Accused’s Demise, Grants Bail 2 Days After Passing Away

A Mumbai court has recently granted temporary bail to an accused person who had passed away at a government hospital on May 9.

The court’s order, spanning 9 pages, did not mention that the accused had passed away.

The lawyers for the accused and complainant told media that neither the Court nor they were informed about the accused’s death.

The accused was booked for cheating & forgery case by the Mumbai police in 2021.

He was then arrested on December 31, 2012 and had been behind bars since then. Chargesheet was filed and trial was in the progress. The bail application highlighted the accused’s severe diabetes and age-related ailments.

Following a toe injury sustained in February 2023, which led to amputation, the accused’s health further deteriorated due to improper medical treatment.

His leg below the knee had to be amputated and his lungs also developed infection.

On May 4, the applicant sought medical bail to receive appropriate care at a private hospital. The Court heard all parties on May 8 and reserved the plea for orders on May 9.

However, the pronouncement of the order was adjourned to the following day due to the complainant’s intervention application.

On May 10, the court was occupied with other matters, leading to a further adjournment of the pronouncement to May 11.

On May 11, the Court granted temporary medical bail for 6 months to the accused on medical and humanitarian grounds, but imposed conditions on the accused.
Consequently, on May 11, the court granted the deceased temporary medical bail for 6 months on medical and humanitarian grounds, imposing conditions.

Unfortunately, the accused had passed away on May 9, 2023, unbeknownst to the court.
