Nitin Desai Suicide: Bombay HC To Hear Edelweiss Officials’ Pleas On Aug 11

The Bombay High Court on Wednesday announced that it would address the petitions of Rashesh Shah, Chairman of Edelweiss Financial Services, and Raj Kumar Bansal, MD and CEO of Edelweiss ARC, on Friday.

Furthermore, to those from Edelweiss, Jitender Kothari, who was appointed as an Interim Resolution Professional by the National Company Law Tribunal, has also appealed to the high court to quash the FIR.

Advocate Amit Desai, on behalf of Edelweiss, urged urgent hearing before Justices NW Sambre and RN Laddha. Meanwhile, Aabad Ponda, representing Kothari, emphasized Kothari’s non-involvement.

Despite scheduled hearings next week, the bench agreed to address petitions on August 11 due to Desai and Ponda’s insistence.

Renowned film artist Nitin Desai, who acclaimed Bollywood movies like “Lagaan” and “Jodhaa Akbar”, was found hanging in his Karjat studio on August 2.
His wife filed an FIR on August 4, resulting in an abetment to suicide case against company officials.

Interim resolution professional Jitender Kothari also faces charges under IPC Sections 306 and 34 for abetment to suicide and common intent.

Shah and Bansal, in their pleas, claim adherence to legal dues recovery. Edelweiss (ARC) lent loans between 2016 & 2018, partially repaid.

So far, Police recorded 10 statements and summoned Bansal and Shah. They approached the High Court, arguing their actions align with legal recovery procedures, negating suicide abetment.”
