Delhi’s Karkardooma Court has granted Shahrukh Pathan a 15-day interim bail to care for his ailing father, who is currently hospitalized.
Pathan, who has been in judicial custody since March 3, 2020, faces prosecution in two riot-related cases, including an allegation of brandishing a firearm at police constable Deepak Dahiya during the 2020 Northeast Delhi riots.
Additional Sessions Judge (ASJ) Sameer Bajpai, after reviewing the medical records and other pertinent details, approved the temporary release. “Looking into the medical condition of the father of the applicant/accused and the fact that the presence of applicant is necessary for taking care of his ailing father and arranging funds for the family, the court deems it just and appropriate to grant 15 days interim bail to the applicant subject to his furnishing a personal bond of Rs.20,000 with one surety in the like amount,” ASJ Bajpai stated in his March 7 ruling.
The court highlighted the severity of Pathan’s father’s medical condition, which was corroborated by hospital records and photographic evidence submitted by the Investigating Officer (I.O.). These documents confirmed his deteriorating health and the necessity of Pathan’s presence for his care.
Advocate Abdullah Akhtar, representing Pathan, filed the bail application, citing medical exigencies. The defense informed the court that Pathan’s father had been admitted to R K Narender Prakash Hospital on March 1, 2025, due to severe health complications. They argued that Pathan’s presence was crucial before and after surgery, as no other male family member was available to provide support. The I.O. verified the authenticity of the submitted medical documents.
Special Public Prosecutor (SPP) Anuj Handa strongly opposed the bail plea, arguing that the charges against Pathan were serious. He expressed concerns that if released, the accused might abscond and evade judicial proceedings.
Conditions Imposed By Court
While granting bail, the court imposed stringent conditions to mitigate the risk of flight. Pathan must provide his mobile number to the Investigating Officer and ensure it remains switched on at all times.
Additionally, he is prohibited from contacting co-accused individuals or witnesses in the case. To ensure compliance, Pathan is required to report to Jafrabad Police Station every alternate day between 10 AM and 11 AM.
This interim bail order balances humanitarian considerations with judicial oversight, ensuring Pathan remains accountable while attending to his father’s medical needs.
